Legal

Terms of use and liability

This is an English translation. If it differs from the German original, the German version applies.

1. Provider

These terms apply to the use of the AMBOSS software (macOS app and panel for your editing software). The provider and your contracting party is Amboss AI UG (haftungsbeschränkt), Kurfürstendamm 50a, 10707 Berlin, registered in the commercial register at the Amtsgericht Charlottenburg (Local Court, Berlin) under HRB 291497 B (“we”). Contact: support@amboss-app.de.

2. Development status

We keep developing AMBOSS. Features we mark as “beta” may change and are not always fully mature yet. This does not affect your statutory rights if something is defective: the statutory warranty rights for digital content and digital services apply to AMBOSS (Sections 327 et seq. of the German Civil Code, BGB).

3. Check the results

AMBOSS changes projects and timelines in your editing software automatically and uses AI services from third parties to do so. AI results, such as edit suggestions, subtitles or generated videos, can be wrong or incomplete. Please check them before you publish them or hand them to clients. We only guarantee specific results if we expressly declare it as a guarantee.

4. Backups

Please back up your projects and media files regularly before using AMBOSS, as thoroughly as their importance to you requires.

5. Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, if we fraudulently conceal a defect, to the extent of any guarantee we have given, and under the German Product Liability Act (Produkthaftungsgesetz).

(2) In other cases of simple negligence, we are only liable if we breach an essential contractual obligation. Essential obligations are those that make proper performance of the contract possible in the first place and that you regularly rely on and may rely on. For AMBOSS, one example is providing the agreed features during the subscription term. In this case our liability is limited to the damage that was typically foreseeable when the contract was concluded.

(3) For loss of or damage to data, in the cases under paragraph 2 we are only liable up to the cost of restoring the data from a backup made as described in section 4.

(4) In all other respects, our liability for simple negligence is excluded.

(5) Paragraphs 2 to 4 also apply in favour of our legal representatives, employees and vicarious agents.

(6) Your statutory rights regarding defects in the software are not affected. Paragraphs 2 to 5 only concern claims for damages and for reimbursement of wasted expenses.

6. Applicable law and place of jurisdiction

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and habitually live in another country, you also keep the protection of that country's mandatory consumer protection rules.

(2) If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Berlin.

7. Final provision

If any provision is invalid, the remaining provisions stay in effect. The statutory rules take the place of the invalid provision.
